The Decision

In the largest Roundup verdict since the $2.05 billion award in 2018, a Missouri jury ordered Bayer and Monsanto to pay $1.56 billion in damages to three plaintiffs who developed Non-Hodgkin’s Lymphoma after using Roundup on their properties. Bayer and Monsanto were found liable for product design defects, company negligence, and failing to warn customers about the cancer risk associated with Roundup exposure.

The plaintiffs received a combined total of $61.1 million in compensatory damages for the suffering they endured. One plaintiff’s family also received an extra $100,000 to compensate for his wife’s suffering. Most notably, each plaintiff received $500 million in punitive damages, making the total punitive damages worth $1.5 billion dollars 95% of the overall settlement value.

Like the 2018 award, this verdict will likely be largely reduced on appeal. Most verdicts with punitive damages exceeding four times the value of compensatory damages are reduced in this manner, so the $1.5 billion in punitive damages is designed mainly to send a message to Bayer and Monsanto about its corporate behavior. 

BAYER AND MONSANTO’S RESPONSE

This is the fourth consecutive trial that Bayer and Monsanto have lost, eliminating their previous winning track record. However, despite dealing with several verdicts in the same year that have only been increasing in size, Bayer and Monsanto’s legal strategy has not changed. They will likely continue to deny accusations that Roundup is dangerous and appeal the decision.

Though Bayer and Monsanto will likely get their wish and convince the judge to appeal the verdict, this strategy to continue denying liability is starting to fail in court. If Bayer and Monsanto don’t decide to reach another settlement to satisfy the thousands of remaining claims, then things could go from bad to worse for the two merger companies.
